ABSTRACT

The consumer of transport services in Nigeria is usually at the mercy of transport service providers who foist booker plates agreements on them as terms of carriage. To further worse their woes, they lack a comprehensive legal framework that takes into cognisance a service liability regime to offer adequate remedy to consumers. This article examines the extant National legal framework for transport service providers. The modicum of protection offered to the consumer is often through the instrumentality of the state, achieving such through legislation targeted at redressing the imbalance in the power relation between the producers and suppliers of services and consumer of transportation services in Nigeria. This study is justified by the need to curtail the practice of shoddy services by the provider of transportation services, thereby, creating laws regulating transport companies and their activities, including criminal penalties for such default. This research proffers recommendations for the lacunae left by existing legal framework.
